National Minimum Wage (2026)
R28.79 per hour for most workers. R15.16 for farm workers. R15.16 for domestic workers. Your employer cannot legally pay you less than this.

Your payslip must include:
Your name and employer's name · Hours worked · Gross pay · All deductions (tax, UIF, pension) · Net pay (take-home amount). If you don't get a payslip, that is illegal.

Overtime
More than 45 hours per week is overtime. You must be paid 1.5x your hourly rate for overtime, or given time off instead. Overtime is limited to 10 hours per week.

The Basic Conditions of Employment Act (BCEA) requires your employer to give you written details of your employment — your job title, working hours, pay rate, and leave. Always ask for this.

Probation periods
Probation is usually 3 months for entry-level jobs. During probation, you still have rights — you still get paid at least minimum wage, and you cannot be dismissed without reason.

Unpaid trial shifts are illegal
If an employer asks you to work a "trial day" without pay, that is against the law. Any work you perform must be compensated.

15 working days paid leave per year (after working for 12 months). You accumulate leave as you work — 1.25 days per month.

Sick Leave
30 days paid sick leave in a 3-year cycle. For the first 6 months, you get 1 day sick leave for every 26 days worked. A doctor's certificate may be required for absences of 2+ consecutive days.

Family Responsibility Leave
3 days paid leave per year for birth of a child, illness or death of a family member. You are entitled to this by law.

Maternity Leave
4 consecutive months unpaid maternity leave. You can claim UIF maternity benefits during this time — up to 66% of your salary from the UIF fund.

You cannot be dismissed without reason
South African law protects you from unfair dismissal. Your employer must follow a fair process — a hearing must be held and you must be given a chance to respond before being dismissed.

Discriminaton is illegal
An employer cannot treat you unfairly because of your race, gender, age, disability, religion, or pregnancy. This is protected by the Employment Equity Act and the Constitution.

If you are unfairly dismissed
You have 30 days to refer a dispute to the CCMA (Commission for Conciliation, Mediation and Arbitration). It's free. Call 0861 16 2626 or visit ccma.org.za.

UIF — Unemployment Insurance Fund
If you are dismissed or retrenched, you can claim UIF. Your employer must deduct 1% from your salary and contribute 1% themselves. Register at uif.labour.gov.za or call 012 337 1680.
